ELIGIBILITY: The Whistler Blackcomb 2013.2014 Season Pass Giveaway (the “Contest”) is open to residents of Canada (excluding Quebec), the United States of America, and the United Kingdom who are at least 13 years old. Employees, representatives and agents of Whistler Mountain Resort Limited Partnership and Blackcomb Skiing Enterprises Limited Partnership (collectively “Whistler Blackcomb”) and their respective affiliates, advertising and promotion agencies and members of the immediate family (parent, child, sibling and spouses) of all such persons as well as those with whom they are domiciled are not eligible to enter. Void where prohibited by law.

HOW TO ENTER: No purchase necessary to enter or win. A purchase will not improve your chances of winning. The Contest will begin at 10:00 a.m. (Pacific Time (“PT”)) on May 26, 2013 and will end at 3:00p.m. (PT) on May 26, 2013 (the “Contest Period”). To enter, visit the Rendezvous Lodge on Blackcomb Mountain or Merlin’s Bar (which opens at 11:00 a.m. (PT) and is located in the Upper Village at the base of Blackcomb Mountain), fill out a ballot and place the completed ballot in the ballot box provided. Only entries received during the Contest Period will be eligible to win. Entries must be submitted in person and must be received at one of the two ballot box locations. No online entries will be accepted.
Participation is limited to one entry per person.
All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of these Rules may be disqualified by Whistler Blackcomb. Whistler Blackcomb takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical, production or other errors. Notably, Whistler Blackcomb is not responsible for any errors or omissions in printing or advertising the Contest or in these Rules.
PRIZE DRAWS: One (1) winner will be selected at approximately 4:00p.m. (PT) on May 26, 2013. The winner will be determined by a random draw by a representative of Whistler Blackcomb from among all eligible entries received by Whistler Blackcomb during the Contest Period. The draw will be held at Merlin’s Bar, located in the Upper Village at the base of Blackcomb Mountain. Entrants do not have to be present at the draw in order to qualify to win.
PRIZE: One (1) Whistler Blackcomb Season Pass for the 2013.2014 winter season.
Approximate retail value in Canadian dollars: adult pass (19 -64) - $1,500.00; senior pass (65 – 74) - $800; youth pass (13 - 18) - $675; super senior pass (75+) - $175.
Any difference between stated approximate retail value and actual prize value will not be awarded. The above prize description constitutes the expected prize and all aspects thereof are subject to availability and subject to change.
ODDS: The odds of winning the prize depends on the number of eligible entries received during the Contest Period.
NOTIFICATION: The entrant selected to win the prize will be notified in person, by email, or by phone on the day the prize winner is selected (May 26, 2013). Before being declared the winner, the selected entrant who is a resident of Canada must correctly answer unaided a time-limited mathematical skill-testing question.
Before being declared a winner of the prize, the selected entrant (or, if the entrant is not of the age of majority, his or her parent or guardian) will be required to agree to a declaration and release form, notably: confirming compliance with these Rules and acceptance of the prize as offered; acknowledging the non-responsibility of Whistler Blackcomb, its respective employees, directors, officers, representatives and agents with respect to liability, damage, injuries, accident, loss or misfortune relating to (i) participation in the Contest or any related activity, and (ii) acceptance, possession, use or misuse of the prize or any component thereof, to the extent permitted by law; and acknowledging the right of Whistler Blackcomb and its respective employees, directors, officers, representatives and agents to collect and publish or broadcast the winner’s likeness, name, address, voice and statements made in relation to the Contest in any publicity, promotion or advertisement carried out by Whistler Blackcomb or its authorized agents worldwide without further notice or compensation, other than the prize offered. In the case of UK residents, this declaration and release must be agreed by the winner in Canada.
The prize must be redeemed by the winner before the end of the 2013.2014 winter ski season at Whistler Blackcomb. Certain components of prizing may be subject to additional rules, restrictions or conditions, such as execution of a waiver required by Whistler Blackcomb. The winner (or his or her parent or guardian) must agree to such rules, restrictions and conditions and acknowledge that if any applicable conditions are not met, winner may not be eligible to redeem the relevant components of the prize.
In the event that the selected entrant is not eligible to claim the prize, or is unwilling or unable to comply with the Rules, or any prize notification is returned as undeliverable, his/her entry will be disqualified and an additional entry will be drawn from among remaining eligible entries received during the Contest Period until such time that the prize has been successfully awarded.
If a winner is awarded but they do not claim the prize before the end of the 2013.2014 winter ski season at Whistler Blackcomb, no prize will be awarded.
Winner is solely responsible for the reporting and payment of any applicable taxes on or associated with the acceptance and use of the prize. Winner may waive his/her right to receive the prize or any component thereof. The prize is non-transferable, non-exchangeable, and non-refundable, has no cash value and must be accepted by winner as awarded. The prize will be forfeited if winner is not able to redeem it during the time period designated by Whistler Blackcomb.
Whistler Blackcomb reserves the right to substitute any of the prizes or a component thereof with a prize of equal or greater value in the event that the prize or a component thereof is unavailable due to circumstances beyond their control. The name of the winner will be posted on the Whistler Blackcomb Facebook page (located at www.facebook.com/whistlerblackcomb) and on the Whistler Blackcomb Twitter page (located at www.twitter.com/whistlerblckcmb).
RULES: The Contest will be run in accordance with these Rules. Entrants must comply with these Rules, and will be deemed to have received and understood these Rules by participating in the Contest. Whistler Blackcomb may, at its discretion, cancel, terminate, suspend and/or amend the Contest and the Rules. The terms of the Contest, as set out in these Rules, are not subject to amendment or counter-offer, except as set out herein. The decisions of Whistler Blackcomb with respect to the Contest are final and binding. If any provisions of the Rules are held to be invalid or unenforceable, all remaining provisions these Rules will remain in full force and effect.
Entrants acknowledge that the Contest is sponsored by Whistler Blackcomb. By entering the Contest, entrants acknowledge that they have read, understood and agreed to be bound by the Rules.
RELEASE: By entering the Contest, entrants acknowledge that they are releasing Whistler Blackcomb, its respective directors, officers, employees, representatives, agents, affiliates, prize suppliers, advertising and promotion agencies (collectively, the “Releasees”) from any liability whatsoever for any claims, costs, injuries, losses, liability or damages of any kind arising out of or in connection with (i) participation in the Contest or any related activity, or (ii) the acceptance, possession, use or misuse of the prizes or any component thereof, (including, without limitation, those related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light), to the extent permitted by law. By entering the Contest, entrants also agree to fully indemnify the Releasees and hold each of them harmless from any and all claims, costs, losses, liability or damages of any kind arising out of or in connection with (i) participation in the Contest or any related activity, or (ii) the acceptance, possession, use or misuse of the prizes or any component thereof, by any third party. For UK residents: Notwithstanding anything to the contrary in these Rules, where the entrant resides in the UK and accepts these Rules from the UK, the exemptions and limitations of liability set out in these Rules shall not operate to exclude or restrict any person’s liability for death or personal injury resulting from such person’s negligence, nor to exempt or restrict a person’s liability for fraud or fraudulent misrepresentation, or for any liability that cannot be limited or excluded by law.
Winner acknowledges that the Releasees are not responsible for: (a) any problems or technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any e-mail to be sent or received by Whistler Blackcomb on account of technical problems or traffic congestion on the Internet or any website, or any combination thereof, including any injury or damage to an entrant’s or any other person’s computer, related to or resulting from playing or downloading materials in this promotion including the recording of game results; (b) any incomplete or inaccurate information, whether caused by the website users or by any equipment or programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of entries; or (c) the theft, destruction or unauthorized access to, or alteration of, entries or the contest website. Whistler Blackcomb reserves the right, in their sole discretion, to cancel, modify or suspend the Contest should a virus or bug or other cause beyond the reasonable control of Whistler Blackcomb corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of the Contest is a violation of criminal and civil laws, and should such an attempt be made, Whistler Blackcomb reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Whistler Blackcomb reserves the right to forbid the framing of any of the contents of the contest website and, in their sole discretion, to disqualify any individual who tampers with the entry process.
All entries become the property of Whistler Blackcomb and will not be returned. A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. All entries must be submitted in person at one of the ballot box locations identified above.
DISPUTES: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Contest, any prize awarded or any use of any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the province of British Columbia, Canada to the extent permitted by law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, your rights and obligations, or the rights and obligations of Whistler Blackcomb in connection with the Contest, any prize awarded or any use of any prize awarded, shall be governed by, and construed in accordance with, the laws of the province of British Columbia, Canada, without giving effect to any choice of law or conflict of law rules that would cause the application of the laws of any jurisdiction other than the province of British Columbia, Canada.
