Contest rules and regulations

ELIGIBILITY:  Whistler Blackcomb’s Student GoPro Giveaway (the "Competition") is open to residents of Canada (excluding Quebec), and the United States of America who have reached the age of majority in the province or state in which they reside at the date of entry. All entrants must be registered at an approved College or University, as defined at http://www.whistlerblackcomb.com/tickets-and-passes/season-passes/student-pass.aspx. Not valid in the province of Quebec or elsewhere where prohibited by law. Employees of Whistler Blackcomb and Whistler Heli-Skiing Ltd. are not eligible to enter. Void where prohibited. The Competition is subject to all federal, provincial, state and local laws and regulations.

 

HOW TO ENTER:  Purchase your 2013.14 Student Season Pass by 11:59:59 pm (PDT) on November 15, 2013 to be automatically entered to win one of four GoPro HD Cameras, valued at $299 (plus applicable taxes). No purchase necessary to enter or win. To enter without purchase, mail a letter to Whistler Blackcomb at 4545 Blackcomb Way, V0N 1B4, stating your request to enter the “Student GoPro Giveaway”. All entries must be received by November 16th.

COMPETITIION PERIOD: The Competition will begin at 9:00:00 am (PDT) on November 5, 2013 and will end at 11:59:59 pm (PDT) on November 15, 2013 (the "Competition Period").

 

PRIVACY: By entering the Competition, entrants consent to the collection, use and disclosure of their personal information for the purposes of administering the Competition and for the purposes of understanding the needs and preferences of individuals or to develop, enhance, market and/or provide products and services. Whistler Blackcomb will collect, use and disclose personal information in accordance with their privacy policy, which can be found at http://www.whistlerblackcomb.com/about-us/privacy-policy.aspx.

 

PRIZES: There are four GoPro HD cameras to be given away as a part of this contest. Each prize is valued at $299 (plus applicable taxes). A random draw by a representative of Whistler Blackcomb will be held at 4545 Blackcomb Way, Whistler BC on November 16, 2013 from among all eligible entries received during the Contest Period. Four entries will be chosen. Odds of winning are dependent on the number of entries received.  Entrants do not have to be present at the draw in order to qualify to win. Once the winning entries have been chosen, the entrants will be notified by email and/or phone if publically available.

CONDITIONS TO WIN: Before being declared a winner of any prize, the selected entrant will be required to sign a declaration and release form confirming compliance with Competition Rules and acceptance of prizes as offered; acknowledging the non-responsibility of Whistler Blackcomb, and their respective agents with respect to injuries, accident, loss or misfortune relating to the prize; and acknowledging Whistler Blackcomb’s and their respective agents’ right to publish or broadcast the winner’s picture, name, address, voice and statements without charge or further compensation other than the prize offered. 

In the event that a selected entrant is not eligible to claim the prize or does not claim the prize within 48 hours of being notified, or is unwilling or unable to comply with the Rules, or any prize notification is returned as undeliverable, that entry will be disqualified and the prize will be awarded to another contestant. 

Winner may waive their right to receive a prize. Competition prizes are non-transferable, non-exchangeable, and non-refundable, have no cash value and must be accepted by the winner as awarded. Whistler Blackcomb reserves the right to substitute a prize of equal or greater value in the event that the specified prize is unavailable due to circumstances beyond their control. 

Entrants acknowledge that this is a Whistler Blackcomb Competition. By entering the Competition, entrants acknowledge that they have read, understood and agreed to be bound by the Rules. 

RELEASE: By entering the Competition, entrants acknowledge that they are releasing Whistler Blackcomb and their respective affiliates, sponsors, advertising and promotion agencies and the immediate family and household members of the above, and each of their respective affiliated companies, directors, officers, employees, representatives and agents from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Competition or with the acceptance, possession, or use of any prize, including any travel, , mountain biking, skiing or snowboarding related thereto (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light). By entering the Competition, entrants also agree to fully indemnify Whistler Blackcomb and their respective directors, officers, employees, parent companies, subsidiaries, affiliates, related companies, suppliers, sponsors and agents and hold each of them harmless from any and all claims costs, losses, or damages of any kind arising out of or in connection with the Competition, including any use of the Prize, by any third parties. 

Rules shall not operate to exclude or restrict any person’s liability for death or personal injury resulting from such person’s negligence, nor to exempt or restrict any person’s liability for fraud or fraudulent misrepresentation, or for any liability that cannot be limited or excluded by law.

DISPUTES:  Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Competition, any prize awarded or any use of any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the province of British Columbia, Canada to the extent permitted by law.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, your rights and obligations, or the rights and obligations of Whistler Blackcomb in connection with the Competition, any prize awarded or any use of any prize awarded, shall be governed by, and construed in accordance with, the laws of the province of British Columbia, Canada, without giving effect to any choice of law or conflict of law rules that would cause the application of the laws of any jurisdiction other than the province of British Columbia, Canada.
